1. Acceptance of Terms

By accessing or using ClearPath ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

ClearPath is an AI-powered resume tailoring service that helps job seekers customize their resumes for specific job postings. The Service includes:

• Resume upload and storage
• Job posting extraction and analysis
• AI-generated tailored resume content
• Coverage analysis and gap identification
• Recruiter perspective feedback
• Chrome extension for job scraping

3. User Accounts

3.1 Registration

You must create an account to use the Service. You agree to provide accurate, current information and keep it updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access.

3.3 Age Requirement

You must be at least 18 years old to use the Service.

4. Subscription Plans & Billing

4.1 Plans

• Free: 5 lifetime Tailor Packs, no credit card required
• Basic ($10/month): 25 Tailor Packs per month
• Pro ($24/month): 75 Tailor Packs per month
• Enterprise: Custom volume and pricing (contact sales)

4.2 Billing

Paid plans are billed monthly on a recurring basis. You authorize us to charge your payment method on the renewal date. Credits reset at the beginning of each billing cycle.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months.

4.4 Refunds

Refunds are provided at our discretion within 14 days of initial purchase only. Contact support for refund requests.

5. Acceptable Use

You agree not to:

• Upload false, misleading, or fraudulent information
• Use the Service for illegal purposes
• Attempt to reverse engineer, hack, or compromise the Service
• Share your account credentials with others
• Scrape or automate access to the Service without permission
• Upload malicious files (viruses, malware)
• Exceed rate limits or abuse the API
• Resell or redistribute generated content as a service

6. Intellectual Property

6.1 Your Content

You retain ownership of your resume content and job postings. By using the Service, you grant us a license to process your content to provide the Service.

6.2 Generated Content

AI-generated tailored resumes are provided to you for your use. You may use, modify, and distribute generated content for personal job applications.

6.3 ClearPath IP

All software, algorithms, designs, and trademarks related to ClearPath are our property. You may not copy, modify, or create derivative works.

7. AI-Generated Content Disclaimer

ClearPath uses AI (OpenAI GPT-4) to generate resume content. While we strive for accuracy:

• Review Required: Always review and verify AI-generated content before use
• Accuracy: We do not guarantee factual accuracy of generated text
• Truthfulness: Do not include AI-generated statements that misrepresent your experience
• Liability: You are responsible for the content you submit in job applications

ClearPath is a tool to help articulate your real experience, not to fabricate credentials.

8. Data Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or emergency repairs without notice.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ClearPath is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for job application outcomes or hiring decisions
• We are not liable for data loss due to user error or account deletion

11. Indemnification

You agree to indemnify and hold ClearPath harmless from any claims arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in abusive behavior. You may delete your account at any time from account settings.

Upon termination, all data will be permanently deleted within 30 days.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
